The evidence adduced at the defendant’s November 2015 trial established that  Mr.  Kaczmarczykbefriended the  victim while the  two  participated in  a six-week residential treatment program for veterans with post-traumatic stress disorder (“PTSD”).  The two remained close after the program ended, and Mr. Kaczmarczykbegan visiting the victim at the home he shared with the defendant.  During this time, the defendant and Mr.  Kaczmarczykbegan a  romantic relationship,  and  the  defendant began discussing plans to kill the victim so that they could be together.

The defendant, who had agreed to be in charge of the victim’s medication, indicated to  Mr.  Kaczmarczyk that  she  had  been mixing medication into  the  victim’s food.  She asked Mr. Kaczmarczyk, who had been prescribed the same medication as the victim, to bring more medication to the residence, and she and Mr. Kaczmarczyk secreted the  medication around the  residence to  make it  appear as  though the  victim had  been hoarding it.  When the victim was hospitalized for a drug overdose, both the defendant and  Mr.  Kaczmarczyk told treating physicians that  the  victim had  expressed suicidal ideations.  After the victim returned home following that hospitalization, the defendant and  Mr.  Kaczmarczykput  into  action a  plan to  overmedicate the  victim and  make  it appear as though he had committed suicide
